The European Investment Bank (EIB) approved €8 billion in financing for energy and infrastructure projects in Europe. The EIB has a €3 billion lending program to Ukraine for 2014-16, with disbursements to date of less than €940 million. Properly prepared public-private partnership projects can apply for the support.
Legislation increasing the viability of Energy Performance Contracts, including necessary budget code amendments, was enacted. P3DP provided significant input to the development and advocacy for the adoption of the reforms. The introduced legislation provides incentives for private sector investment and public-private partnerships in energy sector modernization.
P3DP participated in working group meeting of the Parliamentary Committee on Industrial Policy and Entrepreneurship’s regarding the draft law On Amendments to the PPP Law. Many of P3DP’s recommendations that would closer align the draft law to international best practices were considered. It is expected the final draft law will pass Committee hearings by the end of April and be registered for a vote in the Parliament during May.
Ukraine’s Ministry of Justice announced that it will launch an online service to enable citizens to access business and property rights registration services. P3DP is working with the State Agency for E-Government to identify opportunities for PPPs that can help municipalities to broaden the number of e-services, increasing efficiency and reducing opportunities for corruption.
P3DP highlighted legal and policy changes needed to attract investment through PPPs into Ukraine’s solid waste management sector during the working group meeting of the Ukraine Environmental Alliance Association. GOU officials, NGOs and experts are working to create a set of key recommendations that can guide the development of a national strategy for solid waste management.
The success of P3DP’s biomass heating PPP was presented at a roundtable on PPPs in biomass/gas projects organized by the Local Alternative Energy Solutions in Myrhorod (LAESM) Project. P3DP shared experience and lessons learned with local officials and representatives of business communities, emphasizing the benefits of PPPs and outlining the development process.
– P3DP learned that draft law #2010 On Amendments to Specific Laws on Competitiveness Conditions for Electricity Producing from Alternative Resources of Energy was registered in the Verkhovna Rada. The draft law is based on proposed legislation developed with P3DP participation in April 2014, when P3DP submitted legal recommendations on green tariff mechanisms in solid waste management. The proposed legislation improves methods of energy payment calculations for companies. The law, if passed, will facilitate launching of PPP projects in solid waste management and will greatly support efforts of P3DP in the sector.
The Verkhovna Rada passed in the first reading the Draft Law On Amending Some Legislative Acts of Ukraine in Order to Eliminate Regulatory Barriers to Public-Private Partnership Development in Ukraine and Encourage Investment (#1058). P3DP led the drafting of the legislation and will continue working with the Parliamentary Committee as it collects additional feedback from stakeholders and, if necessary, revise the draft prior to the final reading and adoption vote in March.
PIEC and the Chamber’s Real Estate Working Group discussed PPP-related issues with the Parliamentary Committee on Construction, Urban Development, Housing and Communal Services. The Committee will be working with the CMU on regulatory issues affecting PPP such as urban development, rent, concessions, housing, and communal services. P3DP followed up by providing comments to the Committee on the draft law On Energy Efficiency of Buildings on January 16.
